Construction Disputes in Thai Public Authorities : Causes and Solution Guidelines

บทคัดย่อ (Abstract)

ข้อพิพาทในงานก่อสร้างเป็นปัญหาสำคัญที่ผู้เกี่ยวข้องไม่อยากให้เกิดขึ้นไม่ว่าจะเป็นภาครัฐหรือภาคเอกชน เพราะทำให้งานก่อสร้างล่าช้า และไม่สำเร็จตามวัตถุประสงค์ ซึ่งกระทบต่อเวลา งบประมาณ และคุณภาพของโครงการ แม้ในงานก่อสร้างต่างๆ อาจกำหนดข้อสัญญาอนุญาโตตุลาการเพื่อใช้แก้ปัญหาหรือยุติกรณีพิพาทไว้ก็ตาม แต่ข้อพิพาทที่เกิดอาจก่อความเสียหายขึ้นแล้ว

งานวิจัยนี้มุ่งเน้นเพื่อศึกษาหามูลเหตุข้อพิพาทในงานก่อสร้างของหน่วยงานรัฐ ที่นำไปสู่การฟ้องร้องคดีในชั้นศาล และการกำหนดมาตรการแก้ไข ซึ่งขั้นตอนศึกษาประกอบด้วย 1)วิเคราะห์มูลเหตุที่ทำให้เกิดข้อพิพาทจากคำพิพากษาศาลปกครองสูงสุดที่เกี่ยวข้องกับงานก่อสร้างระหว่างปี พ.ศ.2547 ถึง พ.ศ.2552 จำนวน 115 คดี 2) วิเคราะห์แนวทางการแก้ไขข้อพิพาทจากการสัมภาษณ์ในเชิงลึกจากเจ้าหน้าที่ของหน่วยงานรัฐและเอกชน และ 3) สรุปผลการวิเคราะห์ในภาพรวม

จากการศึกษาพบว่ามีมูลเหตุข้อพิพาทที่เกิดขึ้นในช่วงก่อนสัญญา 6 มูลเหตุ ช่วงระหว่างสัญญา 11 มูลเหตุ และช่วงหลังสัญญา 8 มูลเหตุ โดยมีลักษณะและปริมาณของการเกิดมูลเหตุที่แตกต่างกัน ซึ่งมูลเหตุที่ทำให้เกิดข้อพิพาทมากที่สุดในแต่ละช่วงเวลา เรียงตามลำดับได้แก่ การผิดเงื่อนไขการประมูล ความล่าช้าในการปฏิบัติงาน และการไม่ซ่อมแซม/เพิกเฉย รวมทั้งการผิดสัญญาโดยแนวทางการแก้ไขปัญหาในภาพรวมนั้น หน่วยงานรัฐควรมีการปรับปรุงข้อกำหนดเงื่อนไขของสัญญาจ้างให้มีความยุติธรรมและเกิดความเหมาะสมกับทั้งสองฝ่าย และการพัฒนาปรับปรุงเพื่อเพิ่มประสิทธิภาพการทำงานของเจ้าหน้าที่หรือผู้ที่เกี่ยวข้องในงานก่อสร้าง รวมทั้งการกำหนดแนวทางและวิธีการปฏิบัติงานร่วมกันที่ดี เพื่อลดหรือขจัดข้อพิพาทให้หมดไป

Disputes in construction projects are the major problems that both government and private sectors do not want to be occurred. Disputes cause project delays, excessive budget, and poor quality of work or failures. Even though the arbitration clause may be able to solve disputes, it seems to be too late since damages are already occurred.

This research aimed to study the causes and to determine the solution guidelines of the construction disputes involving Thai government projects and leading to litigation. The methodologies comprised three steps: 1) To analyze the causes of disputes by studying 115 supreme administration court decisions in the government procurement and construction contract disputes occurred during 2004 to 2009, 2) To analyze the solution guidelines for the disputes by in-depth interviews, and 3) To present the overall results of the analysis.

The results showed that there were six, eleven, and eight disputes found during precontract-period, contract period, and post-contract-period, respectively. These disputes were categorized by their causes and concluded by frequency ranking as follows: breaching of bidding conditions, construction delays, ignorance to correct problems, and breaching of contract. This study suggested that the government agencies should modify their contract conditions to be fair and suitable to both parties, train authorized staff to improve their work efficiency, and enhance cooperation among people involved in order to reduce disputes.
